How do you make sure you are the real owner? Checks before buying property in Bosnia

The biggest fear of a Gulf buyer is paying and then finding the property is not in their name. Five documents and steps protect you: the land registry extract, the cadastre, the permits, the notarised contract and registration.

We hear the same story every year: someone bought land “on paper” or through a middleman and years later found they were not the owner in the registry. In Bosnia ownership has one definition: your name in the land registry. Everything else is a promise.

1. The land registry extract (ZK izvadak)

An official court document in three parts: the description of the property, the owner and their share, and the encumbrances such as mortgages, seizures and lawsuits. Ask for a recent one and compare the owner’s name with the seller’s ID. If there are several owners, all must sign.

2. The cadastre

The survey plan shows the parcel number, boundaries and area. It must match the land registry and the situation on the ground. Differences are common with older properties and are fixed before purchase, not after.

3. Permits and land designation

For a house: the building permit and the use permit. For land: its designation in the zoning plan — residential or agricultural — and whether it has legal road access. A house without a permit is a problem you inherit with the key.

4. The contract at the notary

A sale contract is valid only if notarised. If you do not speak the language a sworn interpreter attends. Payment is by documented bank transfer, not cash in hand.

5. Registration in your name

After the contract and tax payment, the registration request is filed and a new extract is issued in your name or your company’s. That is the moment you become the owner.

Warning signs

A seller in a hurry who will not give you the extract, a sale under an old power of attorney, a price far below the market, or a demand for full payment before notarisation. With us, every property goes through these steps before it gets the “Verified” seal.
